1. Introduction
Ever Horizon LLC respects your privacy. This Privacy Policy explains what personal information we collect when you visit everhorizon.us or buy from us, why we collect it, who we share it with, how long we keep it, and the choices and rights you have.
We are the controller of the personal information described here. You can reach us at any time at crew@everhorizon.us or 859-707-9440, or by post at 121 Dewey Dr STE E, Nicholasville, KY 40356, United States.
2. Information We Collect
We collect only what we need to run the shop honestly and well:
- Identity and contact information: your name, email address, telephone number, billing address, and shipping address.
- Order information: the items you purchase, order value, discount codes used, order history, and delivery and tracking details.
- Payment information: the type of payment method, the last four digits of a card, and authorization results. Full card numbers are entered directly into our payment processor's secure checkout and are never stored on Ever Horizon systems.
- Communications: emails, messages, phone notes, reviews, and support requests you send us.
- Marketing preferences: whether you have subscribed to our mailing list and whether you have opted out.
- Technical and usage data: IP address, browser and device type, operating system, referring page, pages viewed, and interactions with the site, collected through cookies and similar technologies.
3. Where the Information Comes From
Most of the information we hold comes directly from you — at checkout, when you sign up for our list, or when you contact us. Some is generated automatically as you browse. A limited amount comes from our service providers: our ecommerce and payment platform confirms order and payment status, our shipping carriers provide delivery events, and our fraud-screening tools return risk indicators on orders.
4. How We Use Your Information
We use personal information for the following purposes:
- To process, fulfill, pack, and deliver your orders, and to send you order confirmations and shipping updates.
- To handle returns, exchanges, refunds, and warranty or condition queries.
- To provide customer support and respond to your questions.
- To send marketing emails about new hauls, restocks, and offers where you have subscribed — you can unsubscribe from any email at any time.
- To detect, prevent, and investigate fraud, chargeback abuse, and misuse of the site.
- To understand how the site is used so we can improve our catalog, pages, and checkout.
- To comply with tax, accounting, consumer-protection, and other legal obligations.
5. Legal Bases for Processing
Where the laws of your jurisdiction require a legal basis for processing, we rely on: performance of a contract with you (fulfilling your order); our legitimate interests (running and securing the business, preventing fraud, improving the site); your consent (marketing emails and non-essential cookies, which you may withdraw at any time); and compliance with legal obligations (tax and record-keeping).
8. Data Retention
We keep order and transaction records for as long as required to fulfill the order and thereafter for the period required by tax, accounting, and consumer-protection law — generally seven years in the United States. Marketing contacts are retained until you unsubscribe and for a short suppression period afterwards so that we do not email you again by mistake. Support correspondence is retained for up to three years. Technical logs are retained for shorter periods, typically no more than twenty-four months.
9. How We Protect Information
Our site and checkout are served over encrypted TLS connections. Payment card data is handled inside our processor's PCI-DSS compliant environment and does not reach our own systems. Access to customer records is limited to people who need it to fulfill orders or provide support, and administrative accounts are protected by strong authentication.
No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and the relevant authorities as required by applicable law.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights in respect of your personal information:
- Access — request a copy of the personal information we hold about you.
- Correction — ask us to fix information that is inaccurate or incomplete.
- Deletion — ask us to erase information we no longer have a lawful reason to keep.
- Portability — receive certain information in a structured, machine-readable format.
- Objection and restriction — object to, or ask us to limit, certain processing.
- Opt out — unsubscribe from marketing, and opt out of any sale or sharing of personal information (we do not sell or share personal information as those terms are defined under California law).
- Non-discrimination — we will not deny service, charge different prices, or provide a lesser experience because you exercised a privacy right.
11. How to Make a Request
Send your request to crew@everhorizon.us or call 859-707-9440. We will acknowledge it promptly and respond within the timeframe required by applicable law — generally within 30 days for California residents and within one month for individuals in the European Economic Area and the United Kingdom, with an extension where a request is complex.
For your protection, we may need to verify your identity by asking you to confirm details of a recent order. An authorized agent may submit a request on your behalf with written proof of authority.
12. California Residents
In the preceding twelve months, we have collected the categories of personal information described in Section 2 for the business purposes described in Section 4, and disclosed them to the categories of recipients described in Section 6. We have not sold personal information and have not shared personal information for cross-context behavioral advertising. We do not knowingly collect or sell the personal information of consumers under 16 years of age.
13. EEA and UK Residents
Ever Horizon operates from the United States. Where we transfer personal information from the European Economic Area or the United Kingdom, we do so using appropriate safeguards, such as Standard Contractual Clauses with our service providers. You have the right to lodge a complaint with your national supervisory authority, although we would appreciate the chance to address your concern first.
14. Children's Privacy
Our site is intended for adults. We sell children's clothing, but the purchaser must be an adult. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will delete it promptly.
15. Third-Party Links and Policy Changes
Our site may link to third-party websites and social platforms whose privacy practices we do not control. Please review their policies before providing information to them.
We may update this Privacy Policy as our practices or the law change. Material changes will be reflected in the effective date at the top of this page, and where required we will notify you directly.
