These Terms of Service ("Terms") form a binding agreement between you and Ever Horizon LLC ("Ever Horizon", "we", "us", or "our"), a limited liability company organized under the laws of the Commonwealth of Kentucky, United States, with its place of business at 121 Dewey Dr STE E, Nicholasville, KY 40356, United States.

By browsing everhorizon.us, creating an account, subscribing to our mailing list, or placing an order for any product — including any curated apparel crate we refer to as a "Pirate Box" — you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy and Returns & Refunds Policy, each of which is incorporated here by reference.

If you do not agree with any part of these Terms, please do not use the site or place an order. Continued use of the site after we post a revised version constitutes acceptance of the revised Terms.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to place an order. Customers under that age may only use the site under the supervision of a parent or legal guardian who agrees to be responsible for the order and for these Terms.

If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us immediately at the contact details below if you believe your account has been used without your authorization.

• Provide accurate, current, and complete information at checkout.
• Keep your shipping address and contact details up to date.
• Do not share your account with anyone who is not authorized to make purchases on your behalf.

Ever Horizon is a curated resale and reuse business. The majority of the garments we ship are pre-owned, surplus, deadstock, or otherwise rescued from disposal streams. Each item is inspected, cleaned, and where necessary mended before it is packed into a Pirate Box.

Because our inventory is rescued rather than manufactured, garments may show gentle honest wear consistent with their age and history. We describe condition as accurately as we reasonably can, and we photograph representative examples rather than every individual garment. Colors may vary slightly between screens and physical goods.

Mystery and curated boxes are, by their nature, assembled at our discretion within the size, category, and price band you select. We do not guarantee any specific garment, brand, print, or colorway within a curated box, and we may substitute items of equal or greater value where stock requires it.

All prices are shown in United States Dollars (USD) and exclude applicable sales tax, duties, and shipping charges unless expressly stated otherwise. Taxes are calculated at checkout based on your delivery address and applicable law.

Your submission of an order is an offer to purchase. No contract is formed until we send you an order confirmation and the order has been accepted for fulfillment. We reserve the right to decline or cancel any order — including after a confirmation email has been sent — where an item is out of stock, where a price or description error has occurred, where we suspect fraud or reseller abuse, or where we cannot lawfully ship to your address. If we cancel an accepted order, we will refund you in full to the original payment method.

Promotional codes, including first-order discounts offered through our email signup, are limited to one per order unless stated otherwise, may not be combined, carry no cash value, and may be withdrawn or modified at any time before an order is placed.

Payment is due in full at the time you place your order. We accept the payment methods displayed at checkout, which may include major credit and debit cards and supported digital wallets.

Card payments are captured and processed by our payment service providers through Shopify's secure checkout. Ever Horizon does not receive, handle, or store full payment card numbers on its own systems. Our providers maintain PCI-DSS compliant environments for the handling of cardholder data.

By submitting payment details, you represent that you are the authorized holder of the payment method used and that sufficient funds or credit are available. If a payment is declined, reversed, or otherwise fails after fulfillment has begun, we may suspend the order and any related account until the balance is resolved.

We screen orders for indicators of fraud and may request additional verification before shipping a high-value or high-risk order. Where verification is not provided, we may cancel and refund the order.

If you believe a charge on your statement is incorrect, please contact us first at the details below. Most issues — a duplicate charge, an unexpected shipping fee, an item that did not arrive — are resolved by us quickly and directly. Filing a chargeback without first contacting us delays resolution for everyone. We reserve the right to contest chargebacks with evidence of order placement, authorization, fulfillment, and delivery, and to decline future orders from accounts with a history of fraudulent disputes.

We ship within the United States and, where indicated at checkout, to selected international destinations. Orders are typically prepared for dispatch within two to five business days; delivery timeframes quoted at checkout are estimates provided by the carrier and are not guaranteed.

You are responsible for supplying a complete and accurate delivery address. Packages returned to us as undeliverable due to an incorrect address may be reshipped at your cost or refunded less outbound shipping.

Title and risk of loss pass to you upon delivery of the goods to the carrier. Where a package is confirmed delivered by the carrier but not received, we will assist you in filing a carrier claim and will work with you in good faith on a resolution.

For international orders, you are the importer of record and are responsible for any customs duties, import taxes, and brokerage fees assessed by the destination country.

We offer a 30-day return window on eligible items from the date of delivery. Full eligibility rules, the return process, refund timing, and instructions for damaged or incorrect items are set out in our Returns & Refunds Policy, which forms part of these Terms.

You may request cancellation of an order at any time before it has been dispatched by contacting us with your order number. Once a package has left our facility, the return process applies.

The Ever Horizon name, logo, ship-and-horizon mark, site design, photography, illustrations, product descriptions, and all other content on this site are owned by or licensed to Ever Horizon LLC and are protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from this site for your own personal, non-commercial use. You may not reproduce, republish, scrape, resell, or otherwise commercially exploit any part of the site or its content without our prior written permission.

When using this site, you agree not to:

• Use the site for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to the site, our systems, or another user's account.
• Introduce malware, run automated scraping or scalping tools, or place bulk orders intended for unauthorized resale.
• Submit reviews, messages, or other content that is false, defamatory, infringing, obscene, or harassing.
• Interfere with the operation, security, or availability of the site or its checkout.

If you submit a review, photograph, testimonial, or other content to us or to our social channels, you grant Ever Horizon a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content in connection with our business. You confirm that you own the content or have permission to share it, and that it does not infringe the rights of any third party. We may remove any submitted content at our discretion.

Except where expressly stated and to the fullest extent permitted by applicable law, the site and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Given the secondhand nature of much of our inventory, we do not warrant that garments are free from all signs of prior use. Nothing in these Terms excludes or limits any statutory consumer right that cannot lawfully be excluded, including rights available to consumers under the laws of your state of residence.

To the maximum extent permitted by law, Ever Horizon LLC, its members, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site or any product purchased through it.

Our total aggregate liability arising out of or relating to any order will not exceed the total amount you actually paid to us for that order.

You agree to indemnify and hold harmless Ever Horizon LLC and its members, officers, and employees from and against any claims, damages, liabilities, costs, and reasonable legal fees arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

These Terms and any dispute arising out of them are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.

We ask that you contact us first so we can try to resolve any dispute informally; most matters are settled within a few days. If a dispute cannot be resolved informally, it will be brought exclusively in the state or federal courts located in Jessamine County or Fayette County, Kentucky, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time to reflect changes to our business, our products, or the law. The effective date at the top of this page indicates when the current version took effect, and the version in force at the time you place an order governs that order.

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and Ever Horizon regarding the site and your orders.
